Correct, although federal law takes precedence in any case...I read about this one the other day, he was charged with violation of a provision of the National Firearms Act (NFA) of 1934...This law was enacted as a tool against organized crime; it effectively banned the unlicensed possesion of full-auto and semi-auto firearms as well as rifles with barrels less than 16 inches in length or shotguns less than 18 inch barrel length...There were other provisions but those were the most well-known...
The gentleman in question possessed an SBS (short-barreled shotgun) without jumping through the government mandated hoops first...He could have gone through a Class III dealer and had his shotgun shortened and applied for the necessary paperwork but he didn't...Given his mental state, I doubt he would have passed the background check anyway...
As far as non-speciallized guns, the federal government does not license their possession and most states do not require licensing or registration...In more enlightened states (like Texas) we can carry long guns or handguns in our vehicles with few exceptions...Here in Texas (and 37 other states) licensed citizens may carry their handguns concealed with few restrictions...This is one reason we have a lower crime rate than more restrictive states...
If the man in Wisconsin had a gun other than the SBS, he might have been charged with only the lesser crimes of discharging a firearm in public or deadly conduct...As it is he faces federal felony charges...Ben
