anyone know anything about UK employment law?


bit of a long shot but any of you guys had any experiance of employment law in respect of the working time directive and on call?

Not really, but my google fu led me to this:

On-call hours count as working time when workers are required to be at their place of work and either working or available for work, and this includes time spent sleeping-in.
When workers are on-call but based at home or elsewhere, on-call time only counts as working time from the time they are called out.


from this handy guide (page 11).

Looks fairly clear cut - if you're on call but at home, you're not on 'working time', so it doesn't count towards your 48 hours unless you catually get the call. If they need you to be in the office whilst on call, then it does count! biggrin.gif

Yeah I had seen that but there are a number of definitions that seem to apply one being inactive (where you are only required to answer the phone) on call or active on call (You have a specified time to respond, be back at work and cannot for example go out or have a drink) that are confusing me.

Do you have a Union rep or helpline that you can pester about it? I'm sure they'll have the lowdown!
